TERMS AND CONDITIONS

'The Photographer(s), 'The Videographer(s)' and 'Company' means Gabriela's Photography and Film and/or anyone acting on behalf of Gabriela's Photography and Film.

'Images' means all photographs, prints, images, albums and/or any other photographic product or other product comprising or containing reproduction of any form of photographic material, and which has been created by the Photographer.

'Footage', 'Video' and 'Images' means all video, images, footage and/or any other visual product or other product comprising or containing reproduction of any form of video material, and which has been created by the Videographer.

'Price' means the price as agreed at the time of the booking.

 'Contract' means the agreed (wedding) package and timings between Photographer and Client of which these terms are an integral part.

Cancellation Policy

Your booking is secured with a £200 non-refundable booking fee.

In the event of a booking cancellation, these terms will be applied:

 

The Client reserves the right to terminate the contract for any reason for up to 4 weeks before the wedding. Should this happen, all money paid minus the deposit, which is £200, will be refunded within 28 days. If the Client terminates the contract less than 4 weeks before the wedding date, the full payment is due.

 

If Wedding Dates are changed, it is the Client's responsibility to inform Gabriela's Photography and Film of updated dates within what is deemed to be a reasonable time-frame. Rescheduled weddings will only be accommodated if the new date does not conflict with an existing booking. Should this conflict occur, all money paid minus the retainer, which is £200, will be refunded within 28 days. 

 

The Client shall not be required to pay Gabriela's Photography and Film for any engagement where the Company is unable to perform by reason of any extreme cause beyond the Client's control; including National Mourning, War, Fire, Acts of Terrorism, Strikes or Lock-Outs directly affecting the venues. Should this happen, all money paid, minus the retainer which is £200 of total cost, will be refunded within 28 days.

 

Gabriela's Photography and Film reserves the right to cancel the clients booking for any reason they deem absolutely necessary. In the unlikely event that Gabriela's Photography and Film cancels your booking, Gabriela's Photography and Film will refund ALL monies paid, within 28 days.

 

If Gabriela's Photography and Film fails to comply with the terms of this agreement, due to any event beyond the control of Gabriela's Photography and Film, including but not limited to: illness, accident, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Gabriela's Photography and Film liability is limited only to a refund of all monies received, within 28 days.

 

In compliance with EU law, Gabriela's Photography and Film will honour the 14 day "cooling off period" with your booking, and so you have the right to cancel this contract within 14 days of booking, for any reason and without justification. This cooling off period expires 14 days after the day you concluded the contract. If the cooling off period expires on a non-working day, your deadline is extended till the next working day.  You will then receive a refund within 14 days of Gabriela's Photography and Film receiving of your cancellation request.

Booking Policy

  1. The Client agrees to secure their time and services of G & A Media by paying a Wedding Booking Fee. This fee is non-refundable or transferable in the event of cancellation.

  2. Following payment of the booking fee, the balance of fees due are to due 4 weeks prior to the wedding.

Duty Policy

  1. Delivery Policy - A sneak preview will be sent to the client within one week of the wedding, wherever possible this will be sent within 48 hours. The remainder of the images will be sent between 10-12 weeks later, unless otherwise having purchased through expediting services as an optional extra. Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence.

  2. G&A Media will not be responsible for coverage loss due to timing changes. If timings are changed, it is the Client's responsibility to inform G&A Media of updated timings within what is deemed to be a reasonable time-frame.

  3. ​It is understood that G&A Media is the exclusive Videographer retained by the Client to cover their wedding. Any conflicts with other video coverage and any notifications necessary to avoid such conflicts, are the sole responsibility of the Client.

  4. ​Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for G&A Media to video each event, public or private.  G & A Media will not be held responsible for coverage lost due to access restrictions. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions.

  5. ​G&A Media  will not be held liable for any production problems beyond our control, e.g. bad weather, accidents, interference from guests etc.

  6. ​G&A Media reserves the right to use videos and photos for display and or promotional purposes. All video masters, raw footage and photographs remain the exclusive property of G&A Media. The Client warrants that he/she has the legal rights to anything G&A Media will capture, including photos, musical recordings, videotapes, or any other materials delivered to G&A Media for inclusion in the Client's video.

Aesthetic Policy

  1. The Client understands and accepts that the photographic coverage will be as G & A Media's professional expertise determines and that not one photograph will be deemed more important than another. Special requests are not binding instructions, although every effort is made to comply with client’s wishes. There is no guarantee that any particular number of images will be produced.

  2. Client acknowledges that he/she is familiar with G&A Media's portfolio and is requesting services with knowledge of the Company’s style and that the Company’s work is constantly evolving; that the Company's services are of a unique and artistic nature; that their photographs may be different from Images done by the Company in the past; and that in creating the Images we shall use our own creative artistic judgment to create Images consistent with our vision of the event, which may be different from the Clients and or the subject’s vision of the event. Accordingly, Client acknowledges that the Images shall not be subject to rejection on the basis of taste or aesthetic criteria.

  3. Editing and Retouching which is illustrated throughout our website and social media, we ask that no additional filters are added when uploading to social media. Any additional edits must be requested within 7 days of receiving the images.

  4. ​The Client(s) grant G & A Media and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the images for social media, editorials, advertising and any other. If there is any reason why certain individuals cannot be shared on social media it is down to the couple to notify the photographer in advance of the wedding.

  5. The Client has critically viewed samples of G&A Media’s work and hereby grants full editorial and production control to G&A Media, for all aspects of the production and post-production services for the event. Changes requested to final Images after delivery to Client are charged at a rate of £45 Per Hour with a minimum of 2 hours charged.

  6. Upon taking possession of the finished product, the Client must inform G&A Media of any technical or other problems with their product within 7 days of receipt. After the 7 day period, if no notification has been received, the Client will be deemed satisfied with the product. 

  7. Client acknowledges that he/she is familiar with G&A Media's portfolio and is requesting services with knowledge of the Company’s style and that the Company’s work is constantly evolving; that the Company's services are of a unique and artistic nature; that the video may be different from video done by the Company in the past; and that in creating the videos we shall use our own creative artistic judgment to create videos consistent with our vision of the event, which may be different from the Clients and or the subject’s vision of the event.   8.
